Terms & Conditions
1. THE PROMOTER:
- The promoter is Heroes & Heretics Limited (we, us and our, company number 14100392), and having our registered office at Create Business Hub, Ground Floor 5 Rayleigh Road, Hutton, Brentwood, Essex, England, CM13 1AB.
2. THESE TERMS AND PRIVACY POLICY:
- These terms apply to all competitions hosted by us on hahcws.com in which entrants buy a ticket, answer a question and are entered into a prize draw if they answer the question correctly. In these terms, we’ll refer to these as prize competitions. By entering any prize competition, you confirm that you agree that these terms and our Privacy Policy (and the way we process personal data) apply to you.
- Our standard Consumer Terms of Business apply to prize competitions too, and your attention is drawn in particular to those terms which relate to the products which we sell and how we describe them, the quality of those products, delivery, how to pay, events outside our control and our responsibilities to you if things go wrong.
3. ELIGIBILITY:
- Prize competitions are open to individuals who are 18 years or older.
- In order to be eligible to win a prize, your shipping address must be in the United Kingdom. Ineligible entries will be discarded.
- Prize competitions are not open to any employees (and their immediate family) of ours or any of our associated companies.
- We reserve the right to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) at any time and we reserve the right, in our sole discretion, to disqualify any individual who, or any entry which, we believe has breached any of these terms, tampered with the entry process or engaged in any unlawful or improper conduct which may undermine the fair and proper conduct of any prize competition.
4. ENTRY PERIOD:
- Each prize competition will have an opening date and time, closing date and time, and a predetermined total number of tickets available for purchase. The closing date and time of the prize competition and the number of tickets still available will be displayed on the relevant page when the prize competition is live.
- If all the tickets have been purchased before the published closing date and time, we reserve the right to end the prize competition entry period early.
5. HOW TO ENTER:
- There are two entry routes – either purchase a ticket or send us a postcard (a free entry route).
Purchase a ticket:
- To enter by purchasing a ticket, eligible individuals must, within the relevant entry period, follow on screen instructions of the relevant prize competition product page on hahcws.com and: (i) complete the purchase of one or more prize competition ticket(s) and (ii) answer correctly a skill or knowledge-based question (you only need to answer the question once if a bundle of multiple competitions tickets is purchased). When all actions are completed, the entrant will have a qualifying entry (or multiple qualifying entries if multiple tickets are purchased) into the prize competition and prize draw.
- Except in the circumstances referred to in clause 9 below, all prize competition tickets, regardless of whether an entrant answered the skill or knowledge-based question correctly or not, are non-refundable.
- Prize competition ticket prices may vary from one prize competition to the next and will be displayed on the relevant prize competition product page. You may be able to purchase multiple competition tickets as a bundle.
- Whilst multiple entries are permitted, we reserve the right to reject, void and/or take appropriate actions to stop any automatically or programmatically generated entries which disrupt the operation of a prize competition and/or the website.
Send Us a Postcard:
- To enter via the free entry route by sending us a postcard, eligible individuals must: (i) send a postcard bearing a valid UK postage stamp to: FAO: Customer Service – Ticketed Prize Competition Team, Heroes & Heretics, 33 Broadwick Street, London, W1F 0DQ, (ii) clearly and legibly include on the postcard: the specific prize competition you wish to be entered into, the correct answer to the skill or knowledge-based question relevant to that prize competition, your name, your email address, your telephone number, and (iii) ensure that the postcard arrives with us before the relevant prize competition ends. When all requirements are met, the entrant will have a qualifying entry into the prize competition and prize draw.
- This entry route does not require a purchase, but entrants shall bear the cost of postage for the postcard. Postcards will not be returned.
- Entrants may only enter a single competition per postcard. Only one entry is permitted per person per competition via the free entry route.
- You need be a resident in the United Kingdom and supply us with a postal address in the United Kingdom, please see clause 8 below for details.
- In respect of both entry routes, the answer to the skill or knowledge-based question will be released at or promptly after such time when the prize draw takes place. Entrants who answer the skill or knowledge-based questions incorrectly will not have a qualifying entry and will not be entered into the prize draw. Entrants who answer the question incorrectly will not be notified individually that they have answered incorrectly. We shall determine the correct answer to the skill or knowledge-based question and that determination shall be final. No correspondence or discussion shall be entered into.
- No prize competition tickets are transferable.
6. WINNER:
- For each competition, one winner will be selected at random out of all qualifying entries shortly after the closing date and time. The selection of the winner made will be final and no correspondence or discussion will be entered into.
- We may contact the winner for feedback in respect of the prize competition and/or prize and may use any feedback provided when announcing the results and promoting our competitions. In all cases, we shall have the right to publish the winner’s first name, the first letter of the winner’s surname and the area in which the winner’s delivery address is located when announcing the results of the prize competition.
7. THE PRIZE:
- The prize of each prize competition will be a bottle (or a bundle of multiple bottles or gift or other presentation pack) of alcoholic beverage. Details of each prize will be clearly stated on the relevant prize competition product page.
- The prize is provided by us and it is strictly non-negotiable, non-transferable, and cannot be exchanged for any cash alternative or for other items. We reserve the right to substitute the prize with an alternative prize of equal or greater value in the event the prize is not available for reasons outside of our control.
8. SHIPPING:
- The prize is inclusive of the costs of packaging and carriage to a valid address within the United Kingdom (Scottish Highlands and Islands).
- Only postal addresses within the United Kingdom will be eligible for entry.
9. ENDING THE PRIZE COMPETITION EARLY:
- We reserve the right to cancel a prize competition where we consider that the prize competition needs to be cancelled in the interests of fairness or safety, because the prize is no longer available or for any other reason which we consider warrants that cancellation, acting reasonably.
- Where we cancel a prize competition under this clause, the prize draw will not be conducted and all prize competition tickets (including those where the skill or knowledge-based question was answered incorrectly) will be refunded. Refunds will be paid by us promptly after the prize competition has been cancelled. All entrants to a prize competition that is cancelled will be informed about the fact of the cancellation and, where appropriate, the reasons for it.
10. CLAIMING THE PRIZE:
- We will make reasonable efforts to contact the winner shortly after the prize draw concludes and the winner is selected, using the contact details provided by the winner.
- In the event that a winner has not been contacted within a week after the prize draw concludes, we recommend that they get in contact with us in order to claim the prize.
- If we have not been able to contact the winner, and the winner has not made contact with us, within 30 calendar days after the prize draw concludes, we reserve the right to select another qualifying entry at random and offer the relevant entrant the prize.
- We cannot accept any responsibility if any winner fails to claim the prize within the time limit as set out above.
11. LIMITATION OF LIABILITY:
- We will not be responsible for any entries that are delayed or lost for any reason (for example, due to technical error, payment error or connection failure).
- We will not be responsible for any free postcard entries which are lost or delayed in transit, regardless of cause, and we will not accept proof of posting as proof of receipt of entry to the prize competition. Any determination of the time a free postcard entry arrives shall be made by us, and that determination shall be final. No correspondence shall be entered into.
- We will not be responsible for delivery of the prize to an incorrect address.
- Insofar as is permitted by law, we, our agents, employees, and/or representatives shall not be responsible or liable to compensate any entrant who participates in the prize competition and/or the winner who claims the prize for any loss, damage, personal injury or death whatsoever and howsoever caused, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any direct, indirect or consequential losses arising out of or in connection with their participation in any competition, except where it is caused by the negligence of us, our agents, employees, and/or authorised representatives. Entrants’ statutory rights are not affected.
12. GENERAL:
- These terms are governed by English law. This means that an entry into a prize competition on these terms and any dispute or claim arising out of or in connection with that entry will be governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.
